Interested persons can also obtain Cumberland County criminal records by conducting criminal background checks through the Tennessee Bureau of Investigation (TBI). This conducts a state-wide search for criminal records in Tennessee, including Cumberland County. A name-based or fingerprint-based criminal background check can be conducted through the TBI. Furthermore, requesters are charged $29.00 per background check, and requests may be submitted online or by mail.

Get Cumberland County Civil Court Records

In Cumberland County, civil cases may be handled by the County Circuit, General Session, or Chancery Court, depending on which court has jurisdiction over the specific type of civil case. The Circuit Court and Chancery Court are trial courts that can handle most types of civil cases. Meanwhile, the General Session Court is a small claims court that can hear civil cases involving less than $25,000. Cumberland County Marriage Records

Marriage records and other types of Cumberland County vital records are primarily maintained and obtainable through the Tennessee Department of Health’s Vital Records Office. According to Tennessee Code § 68-3-205, however, marriage records are unavailable to the public for 50 years after the marriage recordation date. As a result, certified copies of Cumberland County marriage certificates (under 50 years) are only available to eligible persons. These include:

  • The record’s subject, such as the bride or groom named in the record
  • The record subject’s immediate family members, such as their parent, legal guardian, or child(ren).
  • An authorized representative of eligible persons.

Meanwhile, the general public can obtain uncertified copies of Cumberland County marriage records through the Vital Record office, provided the record is older than 50 years. Nonetheless, all requesters must present a valid form of identification when requesting marriage records from the Vital Record Office and are charged a $15 fee per request. The $15 fee covers the cost of furnishing a single copy of the requested marriage certificate, and additional copies cost $15 each.

Cumberland County Divorce Records

Like marriage records, interested persons can request copies of Cumberland County divorce records from the Tennessee Department of Health’s Vital Records Office. Divorce records are protected by Tennessee Code § 68-3-205. Under the statute, divorce records are kept confidential for 50 years after the divorce was recorded. As a result, the general public can request uncertified copies of divorce certificates that are older than 50 years. Meanwhile, certified copies of divorce certificates under 50 years old are only issued to eligible persons, such as parties named on the record and their immediate family members.

The Vital Records Office provides in-person and by-mail options for requesting Cumberland County divorce records. Notwithstanding, requesters must provide a valid form of identification and pay the required fee when requesting divorce records from the Vital Records Office. Requesters are charged $15 per search, and additional copies of a requested divorce certificate cost $15 per copy.

Requests can be made in person at the Vital Records Office during regular office hours. Conversely, requesters can complete the PH-1671 form and mail it with other required items (i.e., fees and a photocopy of the requseter’s ID) to the Vital Records Office for mail-in requests.

Cumberland Birth and Death Records

All Cumberland County vital records, including birth and death records, are preserved by the Tennessee Department of Health’s Vital Records Office. Hence, interested parties can query the Vital Records Office for Cumberland County birth records or death records.

However, per Tennessee Code § 68-3-205, birth and death records remain confidential for 100 years and 50 years, respectively, after their recordation. Hence, the general public is only allowed access to uncertified copies of Cumberland County birth certificates or death certificates that have passed their respective confidentiality periods. Meanwhile, only eligible persons are allowed access to certified copies of birth or death records under 100 years or 50 years, respectively. These eligible persons include:

  • The registrant or decedent
  • The registrant or decedent’s immediate family member
  • An authorized legal representative of any of the aforementioned eligible persons

There are primarily two ways to request birth or death records from the Vital Records Office: in person or by mail. Nevertheless, the requester must provide a valid form of identification and pay a $15 search fee to facilitate their request. Record seekers can visit the Vital Records Office during regular office hours for in-person requests. On the other hand, requesters can complete the appropriate request form for mail-in requests, such as PH-1654 (birth certificate) or PH-1668 (death certificate). The completed request form and all other required items should be mailed to the Vital Records Office mailing address provided on each form. Cumberland County Probate Court Records

In Cumberland County, probate cases fall under the exclusive jurisdiction of the county Probate and Family Court. Hence, all requests for court records of local probate cases should be directed to the Probate and Family Court. Cumberland County Property Records

Two elected offices primarily maintain Cumberland County property records: the County Register of Deeds and the Assessor of Property Office. The Register of Deeds preserves property ownership records, such as deeds, and most legal instruments that can be attached to a property, like liens and other encumbrances.
